All products sold by Earl’s Performance Products are subject to the following warranty at time of shipment: Earl’s Performance Products warrants that said products will be free from defects in material and workmanship, for 90 days. This warranty is limited to the repair or replacement of said products and in no event shall this warranty exceed the original purchase price of the products, nor shall Earl’s Performance Products be responsible for special, incidental or consequential damages. This warranty does not apply to any product subjected to damage in transit, accident, misuse, or abuse following date of original purchase. Earl’s Performance Products reserves the sole and exclusive right to determine if the defect is due to material and/or workmanship or other cause. Any product believed to be defective should be returned to the Dealer from whom purchased for warranty adjustment. IT IS EXPRESSLY UNDERSTOOD AND AGREED THAT THIS WARRANTY SHALL BE IN LIEU OF ALL WARRANTIES OF FITNESS AND IN LIEU OF THE WARRANTY OF MERCHANTABILITY AND THERE ARE NO OTHER WARRANTIES, EXPRESS OR IMPLIED.
